01-04-2009: Entered into force on 31 March most of the measures promised to increase the success rate of executive action and to make it faster. The content of these measures was to increase the responsiveness of the executing agents, turning also lawyers be able to assume this quality (in practice in early 2010) as well as to increase the autonomy of the Judge. At the same time, allowed the executing agents the immediate access to most of the relevant public databases with a view to rapid identification of goods or rights of the debtors.
Public execution database
31-03-2009: Is online since 31 March the list public executions. Applies to enforcement legal proceedings initiated after 31 March 2009 that expired by not having assets seized of the debtor and after 30 days after the end of the process. The list may be used by creditors as a management tool for potential customers, and to recover VAT up to certain value. In turn debtors (generally consumers) can exercise their right to change and rectification of their data or apply for the suspension, but in this case, provided that a payment plan is in force.
