What can I do if the property has defects?

Defects

Legally the property must not suffer from any defect which has a negative impact on its value or which renders its normal use impossible.

If this warranties are breached, a buyer is entitled to ask for:

  • Restoration,
  • Reduction of the purchase price;
  • an annulment of the agreement.

 

Caracteristics, liens and encumbrances

The property must also have the characteristics which the seller has indicated.

In addition the property must be free from any liens or encumbrances. These implied warranties may, however, be waived by the parties.

Dealines

The buyer must notify the seller of defects within one year of their discovery and within five years of the transfer of the property.

If the property is newly built, the buyer will also benefit from a five year warranty period.
