Applicable law
Transfer of title to real estate is generally governed by the Portuguese Civil Code and Real Estate Registry Code, with supplementary provisions on town planning, building and taxation matters.
There are no legal restrictions on ownership of real estate. Non-residents, either individual or corporations can freely acquire real estate in Portugal.
Preliminary contrats
Preliminary contracts must take the same form as the final contract of transfer and therefore must be in writing.
Sale and purchase contract
The contract of transfer must be made in writing.
The contract must be authenticaded by a notary, lawyer, the real estate registration service in order to be recorded in real estate register.
Transfer of titile is effective immediately on the signing of the sale agreement.
